CONSTRUCTION SAFETY ACT 1912—REGULATION

(Relating to the standard for and the inspection of formwork)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Construction Safety Act 1912, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 31 March 1993.

Amendments

2. The Construction Safety Regulations 1950 are amended:

(a)

by inserting in the heading to Part 6 after the word “SCAFFOLDING” the words “AND FORMWORK”;

(b)

by inserting in Regulation 85 (1), in alphabetical order, the following definitions:

“AS 3610” means the Australian Standard entitled

“Formwork for Concrete’’ published by Standards Australia

as in force at 9 April 1990.

“formwork” means formwork for concrete within the

meaning of AS 3610.

(c) by inserting after Regulation 86 (1A) the following paragraph:
(1B) Formwork must comply with the requirements of AS

1992—No. 584

(d) by inserting after Regulation 86 (15) the following paragraphs:

(16) A person must not pour concrete into the formwork for a

suspended slab or beam unless a qualified engineer:

(a)

has inspected the formwork to ensure it complies with Clause 5.3.4 of AS 3610 which relates to the adequacy of components of a formwork assembly; and

(b)

has certified in writing that the requirements of that Clause have been satisfied.

(17) Paragraph (16) does not apply to formwork:

(a) if the deck of the formwork is less than 3 metres above the lowest surrounding ground level; or
(b) if the area of the discrete formwork deck is less than 16

square metres and is designed to hold not more than 2.5 cubic metres or 6 tonnes of wet concrete, whichever measure is appropriate to the circumstances of the case.

EXPLANATORY NOTE

The object of this Regulation is to amend the Construction Safety Regulations

1950 so as:

(a) to prescribe the relevant Australian Standard in relation to formwork for

concrete; and

(b) to require formwork to comply with that Standard; and

(c) to provide that concrete must not be poured into formwork for suspended slabs and beams unless a qualified engineer has inspected the formwork and certified in writing that it complies with certain requirements of that

Standard; and

(d) to exempt from the inspection requirement a formwork deck:

• that is less than 3 metres above ground; or

that has an area less than 16 square metres and is designed to hold
