CONSTRUCTION SAFETY ACT 1912—REGULATION

(Relating to scaffolding and formwork)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Construction Safety Act 1912, has been pleased to make the Regulation set forth hereunder.

Commencement

1.This Regulation commences on 1 February 1994.

Amendments

2. The Construction Safety Regulations 1950 are amended:

(a) byomittingRegulation85andbyinsertinginsteadthefollowing Regulations:

Definitions

85. (1) In this Part:

“AS 1576.1” means the document entitled “AS 1576.1—

1991 (Scaffolding Part 1: General requirements)” published
by Standards Australia as in force at 7 October 1991;

“AS 1576.2” means the document entitled “AS 1576.2— 1991 (Scaffolding Part 2: Couplers and accessories)” published by Standards Australia as in force at 7 October 1991;

“AS 1576.3” means the documents entitled “AS 1576.3—
1991 (Scaffolding Part 3: Prefabricated and tube-and-coupler
scaffolding)” and “AS 1576.3 Supplement 1—1991

byomittingfromRegulation99thewords“AustralianStandard AS 2299—1990 (Occupational Diving) published by Standards Australia as in force at 14 May 1990” and by inserting instead the words “Australian Standard AS 2299—1992 (Occupational diving) published by Standards Australia as in force at 20 July 1992”.

EXPLANATORY NOTE

The object of this Regulation is to change the requirements relating to the

construction, erection and use of scaffolding and formwork.

The Regulation:

(a)

updates references tocertain Australian Standards inPart6 (The Proper Design, Construction, Erection and Use of Scaffolding and Formwork) of the Construction Safety Regulations 1950; and

(b)

removes certain current requirements specified inthose Regulations with which scaffolding and formwork are to comply: and

(c)

replaces those requirements withrequirements to comply withspecified Australian Standards.

This Regulation is made under the Construction Safety Act 1912, including

section 22 (general regulation making power).

(Scaffolding Part 3: Prefabricated and tube-and-coupler scaffolding, Supplement 1: Metal tube-and-coupler scaffolding—Deemed to comply)” published by Standards Australia as in force at 7 October 1991;

“AS 1576.4” means the document entitled “AS 1576.4— 1991 (Scaffolding Part 4: Suspended scaffolding)” published by Standards Australia as in force at 7 October 1 9 9 1 ;

“AS 1577” means the document entitled “Solid Timber Scaffold Planks” published in 1974 by Standards Australia as AS 1577-1974 (exclusive of any amendments);

“AS 1578” means the document entitled “Laminated Timber Scaffold Planks” published in 1974 by Standards Australia as AS 1578-1974 (exclusive of any amendments);

“AS 3610” means the document entitled “Formwork for Concrete” published by Standards Australia as in force at 9 April 1990;

“formwork” means formwork for concrete within the

meaning of AS 3610;

“qualified engineer” means a person qualified for corporate membership of the Institution of Engineers, Australia, having not less than 12 months’ experience in the design of scaffolding.

(2) If there is an inconsistency between a provision of this Part and a provision of AS 1576.1, AS 1576.2, AS 1576.3, AS 1576.4 or AS 3610 the provision of the Standard is to prevail.

(3) In the case of an inconsistency between a provision of this Part and any other Standard, the provision of this Part is to prevail.

Scaffolding or formwork erected or constructed before 1
February 1994

85A. Scaffolding or formwork erected or constructed before 1 February 1994 must comply with the provisions of this Part applicable to it before that date or the provisions of this Part as in force on or after that date.

(b) byomittingRegulation86(IA)andbyinsertinginsteadthe following paragraph:

(1A) Scaffolding must comply with AS 1576.1, AS 1576.2, AS 1576.3 and AS 1576.4, as relevant.

(c) by omitting Regulations 86 (3) (b)-(e), (4)-(15) and 87-94;
