CONSTRUCTION SAFETY ACT 1912 - REGULATION
(Relating to notification of accidents)

HIS Excellency the Governor, with the advice of the Executive
Council, and in pursuance of the Construction Safety Act 1912, has been pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation commences when the Occupational Health and
Safety (Notification of Accidents) Regulation 1990 commences.
Amendment
2. The Construction Safety Regulations 1950 are amended:
| (a) | by inserting in Regulation 122 (15) after the word “Act” the words “(not being an accident which occurs at a place of work)”; |
| (b) | by inserting in Regulation 157F after the word “device” the words “(not being an accident which occurs at a place of work)”; |
| (c) | by inserting in Regulation 157J after the word “stand” the words “(not being an accident which occurs at a place of work)”; |
(d) by inserting after Regulation 157Q (3) the following paragraph:
(3A) Paragraph (3) does not apply to a work-related illness
which has been notified under the Occupational Health and
Safety (Notification of Accidents) Regulation 1990.

(e)
by inserting in Form 27 in the Second Schedule after the words “NOTIFICATION OF ACCIDENT” the words “OTHER THAN AT A PLACE OF WORK”.
EXPLANATORY NOTE
The object of this Regulation is to amend the Construction Safety Regulations 1950 to provide that the provisions relating to the notification of accidents or work-related illnesses under those Regulations do not apply to accidents or illnesses which occur or are suffered at places of work (that is, premises where persons work). The Occupational Health and Safety (Notification of Accidents)
Regulation 1990 will make general provision for the notification of accidents, dangerous occurrences and work-related illnesses at all places of work.
