CONSTRUCTION SAFETY ACT 1912—REGULATION

(Relating to the concentration of airborne asbestos fibres)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Construction Safety Act 1912, has been pleased to make the Regulation set forth hereunder.

Commencement

l . This Regulation commences on 2 September 1996.

Amendments

2. The Construction Safety Regulations 1950 are amended:

(a) by inserting in the definition of “asbestos cement process” in Regulation 84A (1) after the words “involving asbestos cement” the words “with a total surface area of 200 square metres or more” ;
(b)
by omitting from paragraph (a) of the definition of “excess dust”
in Regulation 84A (1) the matter “1.0” and by inserting instead

the matter “0. 5”;

(c)

by omitting from Regulations 84A, 84C, 84D, 84F, 84G, 84I and 84J wherever occurring the words “Chief Inspector” and by inserting instead the word “‘Authority”;

(d) by omitting clause 84D (1) (a).

EXPLANATORY NOTE

This Regulation amends the Construction Safety Regulations 1950:

(a)

to amend the definition of “asbestos cement process” to reflect changes in processes for which a person is required to obtain a licence and approval under the Occupational Health and Safety (Asbestos Removal Work) Regulation 1996; and

(b)

to make the Workcover Authority the authority which grants approvals under the Regulations relating to asbestos processes; and

(c)

to reduce the concentration of certain airborne asbestos fibres required in air before excess asbestos dust is regarded as existing for the purposes of the Regulations.

This Regulation is made under the Construction Safety Act 1950, including section

22 (the general regulation making power).
