CaseChat Overview and Summary
The primary legal issue before the Commission was whether the agreement complied with the requirements of the Fair Work Act, including the provisions concerning the making of a registered agreement. The Commission needed to consider whether the agreement met the standards for good faith bargaining, the inclusion of terms and conditions of employment, and whether the agreement was fair and reasonable.
The Commission found that the agreement satisfied all the requirements of the Fair Work Act. It determined that the agreement was the product of genuine and good faith bargaining between the employer and the union. The agreement contained terms and conditions of employment that were fair and reasonable, and it complied with the provisions of the Act. The Commission concluded that the agreement met all necessary criteria and approved the agreement as a registered enterprise agreement.
The Fair Work Commission approved the Citi-Con (Vic) Pty Ltd and the CFMEU Building and Construction Industry Enterprise Agreement 2011-2015 as a registered agreement under the Fair Work Act 2009.
