CaseChat Overview and Summary

The Construction, Forestry, Mining and Energy Union (CFMEU) sought approval of the Lin & Yu Property Trust T/As L & Y Commercial and the CFMEU Plastering Industry Enterprise Agreement 2011-2015 in the Fair Work Commission. The dispute centred around the terms and conditions of employment for workers in the plastering industry, and whether the proposed enterprise agreement met the necessary standards under the Fair Work Act 2009. The Commission was tasked with determining whether the agreement complied with the procedural and substantive requirements set out in the legislation.

The legal issues before the Commission were whether the agreement had been made in accordance with the correct procedural steps, and if the terms and conditions of employment were fair and reasonable. The CFMEU argued that the agreement was appropriately negotiated and included provisions that were in the best interests of the employees. Conversely, the Lin & Yu Property Trust contended that certain provisions of the agreement were unfair and did not comply with the requirements of the Fair Work Act.

In delivering its decision, the Commission found that the agreement was made following the proper procedural steps, with genuine negotiations between the parties. The Commission also determined that the terms and conditions of employment within the agreement were fair and reasonable, taking into account the nature of the industry, the bargaining positions of the parties, and the overall interests of the employees. The Commission held that the agreement did not contain any unfair provisions and was in line with the objectives of the Fair Work Act. Consequently, the Commission approved the enterprise agreement.

As a result of the Commission's decision, the Lin & Yu Property Trust T/As L & Y Commercial and the CFMEU Plastering Industry Enterprise Agreement 2011-2015 was approved and is now in effect. This decision provides a clear framework for the terms and conditions of employment for workers in the plastering industry and ensures that the agreement meets the necessary standards under the Fair Work Act.
