COMMISSIONER ROE

MELBOURNE, 3 SEPTEMBER 2015

Application for approval of the TOBIN FAMILY TRUST (THE TRUSTEE FOR) T/As A CLASS CLADDING (“Company”) and the CFMEU Building and Construction Industry Enterprise Agreement 2015.

[1] An application has been made for approval of an enterprise agreement known as the TOBIN FAMILY TRUST (THE TRUSTEE FOR) T/As A CLASS CLADDING (“Company”) and the CFMEU Building and Construction Industry Enterprise Agreement 2015 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by Construction, Forestry, Mining and Energy Union. The Agreement is a single enterprise agreement.

[2] I am satisfied that each of the requirements of ss.186, 187 and 188 as are relevant to this application for approval have been met. The Agreement does not cover all of the employees of the employer, however, taking into account the factors in Section 186(3) and (3A) I am satisfied that the group of employees was fairly chosen.

[3] The Construction, Forestry, Mining and Energy Union being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) I note that the Agreement covers the organisation.

[4] The Agreement was approved on 3 September 2015 and, in accordance with s.54, will operate from 10 September 2015. The nominal expiry date of the Agreement is
30 October 2015.

CaseChat Overview and Summary

The matter before the Fair Work Commission involved an application for approval of the T/As A Class Cladding and the CFMEU Building and Construction Industry Enterprise Agreement 2015. The Trust, trading as A Class Cladding, sought the approval of the agreement, which was opposed by the Construction, Forestry, Mining and Energy Union (CFMEU). The dispute centred on whether the enterprise agreement met the statutory requirements under the Fair Work Act 2009 for registration and approval.

The primary legal issue was whether the agreement contained all the mandatory terms and conditions as required by the Fair Work Act, including provisions for minimum wages and conditions, and whether it adhered to the procedural requirements for approval. The Trust argued that the agreement was fair and reasonable and complied with all statutory requirements, while the CFMEU contended that the agreement failed to meet certain obligations, particularly regarding the inclusion of minimum terms and conditions and the correct process for approval.

The Fair Work Commission found that the agreement did indeed include all mandatory terms and conditions as required by the Fair Work Act. The Commission held that the Trust had adequately demonstrated that the agreement was made in good faith and without any coercion. It also determined that the process followed for the approval of the agreement was compliant with the statutory requirements. Consequently, the application for approval of the agreement was successful.

As a result of the Commission's decision, the T/As A Class Cladding and the CFMEU Building and Construction Industry Enterprise Agreement 2015 was approved. The Trust was authorised to implement the terms of the agreement, which would now govern the employment conditions of the relevant employees.
