CaseChat Overview and Summary
The primary legal issue before the Commission was whether the proposed enterprise agreement met the necessary criteria for approval under the Fair Work Act. This included assessing whether the agreement provided for a safety net of minimum wages and conditions, facilitated genuine collective bargaining, and did not discriminate against employees on the basis of their union membership or activities.
The Commission found that the proposed enterprise agreement complied with the relevant legislative requirements. The agreement provided for a safety net of minimum wages and conditions, facilitated genuine collective bargaining, and did not discriminate against employees on the basis of their union membership or activities. Therefore, the Commission approved the enterprise agreement.
As a result of the Commission's decision, the enterprise agreement between Rock Solid Civil Contractors Pty Ltd and the Construction, Forestry, Maritime, Mining and Energy Union (Victorian Construction and General Division) for the period 2016-2018 was approved and is now legally binding on both parties.
