CaseChat Overview and Summary
The central issue was whether the collective agreement satisfied the requirements under section 234 of the Fair Work Act. The FWC considered whether the agreement had been made in good faith and whether it provided for the proper administration of the workplace. The FWC also needed to determine if the agreement provided for the proper management of the enterprise. Given the opposition from Commercial Sealing Systems Pty Ltd, the FWC had to weigh the arguments presented by both parties and decide if the agreement could be approved despite the opposition.
After considering the evidence and submissions from both parties, the FWC found that the collective agreement met the criteria for approval. The FWC was satisfied that the agreement had been made in good faith and provided for the proper administration and management of the workplace. The FWC also determined that the agreement was fair and reasonable, taking into account the interests of both the employees and the employer. As a result, the FWC approved the collective agreement.
