CaseChat Overview and Summary
The legal issues before the Commission included whether the agreement provided for a fair and reasonable minimum rate of pay, appropriate working hours, and adequate conditions for the employees. Additionally, the Commission had to consider whether the agreement complied with the procedural fairness requirements under the Fair Work Act, including whether it was genuinely negotiated and whether the union had adequately represented its members. The employer argued that the agreement was fair and reasonable, while the union maintained that the terms were acceptable and in the best interests of the employees.
After thorough consideration of the arguments and evidence presented by both parties, the Commission found that the agreement met the legal standards required by the Fair Work Act. The Commission noted that the agreement provided for a fair and reasonable minimum rate of pay, appropriate working hours, and adequate conditions for the employees. The Commission also found that the agreement had been genuinely negotiated and that the union had adequately represented its members. Consequently, the Commission approved the agreement and made an order for its registration.
The final orders of the Commission were that the EDCORE CIVIL and the CFMEU (Victorian Construction and General Division) Subcontractors Earthmoving, Excavation and Drainage Enterprise Agreement 2020-2023 be approved and registered as a registered agreement under section 171 of the Fair Work Act 2009. The agreement became effective from 1 July 2020 and will remain in force until 30 June 2023.
