Alteration of other rules of organisation.

  1. On 11 October 2019, the Mining and Energy Division (the Division) of the Construction, Forestry, Maritime, Mining and Energy Union lodged with the Fair Work Commission a notice and declaration setting out particulars of alterations to the rules of the Division.

  1. The particulars set out alterations to the following Divisional Rules:

·  7 – Entitled to Vote;

·  8 – Central Council;

·  10 – Central Executive; and

·  17 – Ballot.

  1. The alterations have the following effect:

·  Removing the stipulation that only the Annual General Meeting of Central Council shall be empowered to call a National Council;

·  Providing a mechanism for the Central Executive to transact business otherwise than at an assembled meeting;

·  Providing that a Local Returning Officer or Assistant Local Returning Officer may be compensated for costs incurred in conducting an election; and

·  Various other minor changes associated with formatting or providing clarification.

  1. On the information contained in the notice, I am satisfied the alterations have been made under the rules of the organisation.

  1. In my opinion, the alterations comply with and are not contrary to the Fair Work (Registered Organisations) Act 2009, the Fair Work Act 2009, modern awards and enterprise agreements, and are not otherwise contrary to law. I certify accordingly under subsection 159(1) of the Fair Work (Registered Organisations) Act 2009.
