CaseChat Overview and Summary
The primary legal issue was whether the proposed agreement met the criteria for registration under the Fair Work Act 2009. Specifically, the Commission needed to determine if the agreement provided for the minimum entitlements of employees, was free from prohibited content, and did not contravene any provisions of the Act. Another issue was whether the agreement fairly reflected the balance of power between the parties and whether it was made in good faith.
The Commission found that the proposed agreement was consistent with the requirements of the Fair Work Act. It provided for minimum entitlements and did not contain any prohibited content. The agreement was also found to be made in good faith and fairly reflected the balance of power between the parties. The Commission approved the agreement and registered it on the Register of Approved Agreements.
The Fair Work Commission approved the proposed agreement and registered it as the Subcontractors Earthmoving, Excavation and Drainage Enterprise Agreement 2020-2023. This agreement is now binding on the parties and their employees for the duration of the agreement.
