CONSTITUTION (REFERENDUM) ACT, 1977

An Act to provide for the holding of a referendum upon the Bill entitled "A Bill for an Act to provide for the election of Members of the Legislative Council directly by the people". [Assented to, 28th June, 1977.]

Parliament assembled, and by the authority of the same, as follows:—

1. This Act may be cited as the "Constitution (Refer­

endum) Act, 1977".

2 .      (1) Sections 1 and 3 and this section shall commence

on the date of assent to this Act.

(2) If the 1977 reconstitution Bill—

(a)

has, before the date of assent to this Act, been passed by both Houses of the Legislature, section 4 shall commence on the date of assent to this Act; or

(b)

is, on or after the date of assent to this Act, passed by both Houses of the Legislature, section 4 shall commence upon the 1977 reconstitution Bill being passed by both Houses of the Legislature.

3. In this Act, "the 1977 reconstitution Bill" means—

(a)

except as provided by paragraph (b), the Bill entitled "A Bill for an Act to provide for the election of Members of the Legislative Council directly by the people" as introduced into the Legislative Assembly on 1st June, 1977; or

(b)

(b)

if that Bill has, before the date of assent to this Act, been passed or is, on or after that date, passed, in either case with amendments to which both Houses of the Legislature have agreed—that Bill with those amendments.

4. (1) The 1977 reconstitution Bill shall be submitted by way of referendum to the electors qualified to vote for the election of Members of the Legislative Assembly.

(2) The day appointed for the taking of the votes of

the electors at the referendum is—

(a)

except as provided in paragraph (b)—10th June,. 1978; or

(b)

where any law of the Commonwealth precludes a referendum of the State from being held on 10th June, 1978, or precludes such a referendum from being held on that date except with the authority of any person specified in that law—17th June,. 1978.

(3) The referendum shall be conducted in accordance

with the provisions of the Constitution Further Amendment

(Referendum) Act, 1930.
