Act N o . 7 7 , 1978 .

An Act to amend the Constitution and Police Regulation (Amendment) Act, 1964, with respect to the candidature of a member of the police force at an election of members of the Legislative Council. [Assented to, 11th September, 1978.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—

1. This Act may be cited as the "Constitution (Police

Regulation) Amendment Act, 1978".

2. The Constitution and Police Regulation (Amendment) Act,

1964, is amended—

(a) by omitting from the long title the words "Legislative
Assembly" and by inserting instead the words

"Legislative Council or Legislative Assembly";

(b)
(i) by omitting from section 2(1) the word "twenty- six" and by inserting instead the matter "13B";
(ii) by omitting from section 2 (2) (a) the words "to contest an election of" and by inserting instead the words "to contest a periodic Council election within the meaning of section 3 of the Constitution Act, 1902, or an election of a member or";
(iii) by omitting from section 2 (2) (c) the words "Legislative Assembly" and by inserting instead the words "Legislative Council or Legislative Assembly";
(c) by omitting from section 3 the words "an election of a member or members of the Legislative Assembly of New South Wales" and by inserting instead the words "an
election referred to in section 2 (2) ( a ) " .
