An Act to amend the Constitution Act 1902 to enable Members of the Legislative Council to be appointed as Parliamentary Secretaries; and to make a consequential amendment to the Parliamentary Remuneration
Tribunal Act 1975. [Assented to 10 June 1988]

Constitution (Parliamentary Secretaries) Amendment 1988

The Legislature of New South Wales enacts:

Short title

  1. This Act may be cited as the Constitution (Parliamentary Secretaries)

Amendment Act 1988.

Commencement

2.     This Act commences on the date of assent.

Amendment of Constitution Act 1902 No. 32

  1. The Constitution Act 1902 is amended as set out in Schedule 1.

Consequential amendment of Parliamentary Remuneration Tribunal Act 1975

No. 25

4. The Parliamentary Remuneration Tribunal Act 1975 is amended as

set out in Schedule 2.

Operation of amendments

5. This Act affects neither the office of a Parliamentary Secretary held by a Member of the Legislative Assembly at the commencement of this Act nor he remuneration payable to the holder of the office.

SCHEDULE 1—AMENDMENT OF CONSTITUTION ACT 1902

(Sec. 3)

(1) Section 1 3B (Office of profit or pension from Crown)

Section 13B (3) (c)—

Omit "the Legislative Assembly", insert instead "either House of

Parliament".

(2) Section 38B (Appointment of Parliamentary Secretaries)

Section 38B (1)—
Omit "the Legislative Assembly", insert instead "either House of

Parliament".

(3) Section 3 8 D (How Parliamentary Secretary ceases to hold office)

(a) Section 38D(l)(e)—
Omit "the Legislative Assembly" where firstly occurring, insert

SCHEDULE 2—CONSEQUENTIAL AMENDMENT OF

PARLIAMENTARY REMUNERATION TRIBUNAL ACT 1975

(Sec. 4)

Schedule 1 (Recognised Offices)

Omit paragraph (r), insert instead:

(q 1) Parliamentary Secretary in the Legislative Council,

(r) Parliamentary Secretary in the Legislative Assembly.
