Constitution (Metropolitan Ambulance Service Royal Commission Report) Act

The Parliament of Victoria enacts as follows:

1. Purpose

The purpose of this Act is to make provision for the publication of the report of the Metropolitan Ambulance Service Royal Commission.

2. Commencement

This Act comes into operation on the day after the day on which it receives the Royal Assent.

3. Amendment to the Constitution Act 1975

After section 74AA of the Constitution Act 1975 insert—

'74AB. Publication of Metropolitan Ambulance

Service Royal Commission Report

(1) In this section—

"Commissioner" means the Commissioner

appointed under section 88B of the
Constitution Act 1975 by the Letters

Patent;

"Letters Patent" means Letters Patent

dated 21 December 1999, a copy of
which was published in the
Government Gazette on 22 December

1999, as amended from time to time;

"Metropolitan Ambulance Service

inquiry" means the inquiry conducted
by the Commissioner in accordance

with the Letters Patent.

(2) On receipt by the Governor of a copy of a

report from the Commissioner of the results
of the Metropolitan Ambulance Service
inquiry and his recommendations, the

Minister—

(a) must give a copy of the report to the clerk of each House of the Parliament; and
(b) must cause the report to be published by the Government Printer.

(3) A copy of the report given to the clerk of a House of the Parliament under sub-section (2) is deemed to have been ordered by the House to be printed and a copy of the report

as published shall be tabled in the House on

the next sitting day of the House.

(4) The publication of the report of the

Commissioner in accordance with this section is absolutely privileged and the provisions of sections 73 and 74 of the Constitution Act 1975 and any other enactment or rule of law relating to the publication of the proceedings of the Parliament apply to and in relation to the publication of the report as if it were a report to which those sections applied and had been published by the Government Printer under the authority of the Parliament.'.

4. Supreme Court—limitation of jurisdiction

After section 85(8A) of the Constitution Act

1975 insert—

"(8B) Section 74AB alters or varies this section

and has effect as a direct amendment of this
section.".

5. Repeal of sections 74AB and 85(8B) of the Constitution Act 1975

Sections 74AB and 85(8B) of the Constitution Act 1975 are repealed on the day that is the first sitting day of the Legislative Assembly after the day on which this Act receives the Royal Assent.
