Constitution (Governor's Salary) Amendment Act 2015

An Act to amend the Constitution Act 1934.

The Parliament of South Australia enacts as follows:

Part 1Preliminary1Short title

This Act may be cited as the Constitution (Governor's Salary) Amendment Act 2015.

2Commencement

This Act will come into operation on a day to be fixed by proclamation.

3Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2Amendment of Constitution Act 19344Substitution of section 73

Section 73—delete the section and substitute:

73—Governor's salary

  1. (1)

    The Governor is entitled to a salary at a rate determined by the Remuneration Tribunal in relation to the office of Governor.

  2. (2)

    Remuneration is not payable under this section to the Governor for any period for which he or she is entitled to remuneration from the Commonwealth in respect of his or her administration of the Government of the Commonwealth.

  3. (3)

    A rate of salary determined under this section cannot be reduced by subsequent determination of the Remuneration Tribunal.

5Amendment of section 73B – Appropriation

Section 73B—delete "of the Governor's salary and the other costs that are to be borne by the Treasurer out of the Consolidated Account" and substitute:

, out of the Consolidated Account, of the Governor's salary referred to in section 73 and the costs referred to in section 73A

Schedule 1—Transitional provision

1—Transitional provision

The rate of salary determined by the Remuneration Tribunal under section 73 of the Constitution Act 1934 Act (as inserted by this Act) in relation to the office of Governor cannot be lower than the rate applying before the commencement of this Act.
