Act No. 52, 1988

An Act to amend the Constitution Act 1902 so as to make provision for the

salary of the Governor, and to repeal the Governor's Salary Act 1901.

Constitution (Governor's Salary) Amendment 1988

The Legislature of New South Wales enacts:

Short title

1. This Act may be cited as the Constitution (Governor's Salary)

Amendment Act 1988.

Amendment of Constitution Act 1902 No. 32

2. The Constitution Act 1902 is amended by inserting after section 9H

the following section:
Governor's salary

9i. (1) The annual amount payable for the salary of a Governor appointed to that office is $80,000 or such greater amount as is determined from time to time by regulation.

(2) Such a regulation may be made by a Governor (whether or not his or her salary is thereby affected), or by any person for the time being administering the Government, or by a deputy in accordance with section 9D, but may be made only on the advice of a majority of the members present at a meeting of the full Executive Council.

(3) For the purposes of this section, the full Executive Council is the Executive Council constituted by all its members, other than members (not exceeding three) who are unavailable by reason of absence or disability or for any other reason.

(4) The salary of a Governor as provided for from time to time
under this section is not capable of being reduced by the making,

amendment, operation, expiry or repeal (otherwise than on

disallowance) of a regulation.

(5) The salary of a Governor as provided for from time to time under this section is payable out of the Consolidated Fund, which is accordingly appropriated to the necessary extent.

(6) Salary is not payable under this section to a Governor for any period for which he or she is entitled to salary from the Commonwealth in respect of his or her administration of the Government of the Commonwealth.

Operation of Act

4. Nothing in this Act affects or applies to the salary of a Governor

holding office at or before the date of assent.
