Constitution (Electoral Redistribution) (Appeals) Amendment Act 2017

An Act to amend the Constitution Act 1934.

The Parliament of South Australia enacts as follows:

Part 1Preliminary1Short title

This Act may be cited as the Constitution (Electoral Redistribution) (Appeals) Amendment Act 2017.

2Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2Amendment of Constitution Act 19343Amendment of section 86 – Order of the Commission
  1. (1)

    Section 86—after subsection (1) insert:

    1. (1a)

      The order published in the Gazette under subsection (1) must include a statement of the right of any elector or registered political party to appeal against the order within 1 month of its publication.

  2. (2)

    Section 86(2)—after "elector" insert:

    or a registered officer on behalf of a registered political party

  3. (3)

    Section 86—after subsection (5) insert:

    1. (5a)

      If an appeal is instituted under this section, the notice of appeal must be—

      1. (a)

        notified in the Gazette by the Commission; and

      2. (b)

        published on a website determined by the Commission; and

      3. (c)

        sent by the Commission to each person who made a representation to the Commission under section 85.

    2. (5b)

      The notification under subsection (5a)(a) must include a statement setting out the rights of any person having an interest in the proceedings to apply to be joined as a party to the proceedings.

  4. (4)

    Section 86—after subsection (9) insert:

    1. (10)

      In this section—

    registered officer and registered political party have the same respective meanings as in the Electoral Act 1985.
