Constitution (Doubts Removal) Act 1999

An Act to provide that the seat in the Legislative Council of the Honourable John Charles White did not become vacant by reason only of his having been appointed as Chair of the State Committee of the Centenary of Federation and to provide for related matters

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1Short titleThis Act may be cited as the Constitution (Doubts Removal) Act 1999 . 2CommencementThis Act is taken to have commenced on 29 June 1999. 3Removal of disability of John Charles White (1) The acceptance before the commencement of this Act by the Honourable John Charles White, a person who was at that commencement a duly elected member of the Legislative Council, of the office of Chair of the State Committee of the Centenary of Federation is taken not to have constituted an acceptance of an office of profit for the purposes of section 32 of the Constitution Act 1934 . (2)  Without limiting subsection (1) , the acceptance before the commencement of this Act by the Honourable John Charles White of the office referred to in that subsection is taken not to have had the effect of rendering his seat in the Legislative Council vacant or of rendering him incapable of sitting or voting as a member of the Council. 4Contract or agreement taken not to have arisenNo contract or agreement for the purposes of section 33 of the Constitution Act 1934 is to be taken as having arisen in connection with the appointment before the commencement of this Act of the Honourable John Charles White, a person who was at that commencement a duly elected member of the Legislative Council, as Chair of the State Committee of the Centenary of Federation. 5Administration of ActUntil provision is made in relation to this Act by order under section 4 of the Administrative Arrangements Act 1990  – (a) the administration of this Act is assigned to the Premier; and (b) the department responsible to the Premier in relation to the administration of this Act is the Department of Premier and Cabinet.
