Constitution Amendment (Demise of the Crown) Act 2017

An Act to amend the Constitution Act 1889.

[Assented to 25 October 2017]

The Parliament of Western Australia enacts as follows:

1.Short title

This is the Constitution Amendment (Demise of the Crown) Act 2017.

2.Commencement

This Act comes into operation as follows —

• (a)

  sections 1 and 2 — on the day on which this Act receives the Royal Assent;

• (b)

  the rest of the Act — on the day after that day.

3.Act amended

This Act amends the Constitution Act 1889.

4.Section 74A inserted

After section 74 insert:

74A. Demise of the Crown

The demise of the Sovereign —

• (a)

  has the effect of transferring all the functions, duties, powers, authorities, rights, privileges and dignities belonging to the Crown to the Sovereign’s successor; but

• (b)

  has no other effect in law for any purpose.
