CONSTITUTION (AMENDMENT)

ACT.

Act No. 1, 1936.

An Act to provide that during the absence from the State of New South Wales of the Speaker of the Legislative Assembly the Chairman of Committees of the Legislative Assembly shall act in his place; for this

purpose to amend the Constitution Act,

1902; and for purposes connected therewith.

[Assented to, 25th March, 1936.]

BE it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis­ lative Council and Legislative Assembly of New South
Wales in Parliament assembled, and by the authority of
the same, as follows :—

1. This Act may be cited as the "Constitution (Amend­ ment) Act, 1936."

2. The Constitution Act, 1902, as amended by sub­ sequent Acts, is amended by inserting after section thirty-one the following new section:—

31A. (1) During the absence from New South

Wales of the Speaker the Chairman of Committees

of the Legislative Assembly shall act in his place,

and for all purposes, whether of this Act or other­

wise, shall have and may exercise and perform all
the powers, authorities, duties and functions of the
Speaker.

(2) Without prejudice to the generality of sub­

section one of this section the Chairman of Com­
mittees of the Legislative Assembly, while acting in the place of the Speaker under that subsection, shall

be deemed to be the Speaker for the purposes of sec­

tion seventy-one of the Parliamentary Electorates

and Elections Act, 1912-1935.
