[A ssented to 17 th S eptember , 1953.] B E it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legis lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:— I. P art —P reliminary . PS™r. 1. (1.) This Act may be cited as “ The Short Constitution Acts Amendment Act of 1953.” (2.) *“ The Constitution Acts, 1867 to 1950,” and Collective this Act may be collectively cited as “ The Constitution tltle' Acts, 1867 to 1953.” (3.) This Act shall be deemed to have come into force Commence- on the first day of July, one thousand nine hundred and ment ofAct- fifty-three, and shall operate retrospectively accordingly. 2. This Act applies as well to members of the Application present Legislative Assembly as to the members of every of Aot' Legislative Assembly hereafter to be summoned and chosen: Provided that— (a) A member of the present Legislative Assembly in office as such at the passing of this Act shall not be entitled to be paid, and shall not be paid, the increase of two hundred pounds as prescribed by this Act in the annual rate of the payment or salary (exclusive of the allowances for mileage and passage money) payable to him under The Constitution Act Amendment Act of 1896,” (or, in the case of such a member to whom J“ The Officials in Parliament Acts, 1896 to 1953,” apply payable to him thereunder) immediately prior to the first day of July, one thousand nine hundred and fifty-three, unless, within twenty-eight days after the date of the passing of this Act, he shall notify in writing the Clerk of the Legislative Assembly that he desires to take that increase; and * 81 Y. No. 3, (b) That, in the case of a member who fails to so notify the said Clerk, this proviso shall apply so that notwithstanding that he may be re-elected as a member at any time or from time to time, he shall nevertheless not be paid the said increase of two hundred pounds. CONSTITUTION. 87 P art II — 1953. Constitution Acts Amendment Act. A mendments op “T he C on stitution A ct A mendment (ii.) The words “ one thousand eight hundred and A ct op 1896.** seventy-five ” are repealed and the words “ two thousand and seventy-five ” are inserted in lieu of those repealed words; (iii.) The words “ one thousand four hundred and seventy-five ” are repealed and the words “ one thousand six hundred and seventy-five ” are inserted in lieu of those repealed words. (b) The following section is inserted after section four thereof, namely :— “ [4 a .] (I.) In and for the purposes of this section—ofdpayment8 (a) The term “ Pubhc Service Award—State ”to members- means that award under and within the meaning of *“ The Industrial Conciliation and Arbitration Acts, 1932 to 1952,” as in force immediately prior to the fourth day of May, one thousand ' nine hundred and fifty-three ; and (6) The term “ all comparable classified public service positions ” means those positions collectively (held by officers who, having qualified by examination for admission to the Public Service, have been appointed thereto in accordance with the provisions oi^The Public Service Acts, 1922; to 1950”) which are classified by and under the Public Service Award—State with minimum and maximum salaries at the rates respectively of one thousand four hundred and fifty pounds and one thousand seven hundred pounds per annum. (2.) The annual rate of any and every payment or salary (exclusive of the allowances for mileage and passage money) under this Act shall be adjusted from time to time in accordance with any and every variation of the actual annual salary in respect of the first year in office payable for the time being to holders respectively of all comparable classified pubhc service positions made on or after the first day of July, one thousand nine hundred and fifty-three, in pursuance of the provisions of *“ The Industrial Conciliation and Arbitration Acts, 1932 to 1952.” * 23 G. 5 No. 36 and amending Acts, f 13 G. 5No. 31 and amending Acts.

Such an adjustment shall be so made by increasing or, as the case requires, decreasing the annual rate for the time being of the payment or salary under this Act in question by a sum equal to the annual amount by which the aforementioned actual annual salary shall have been or shall be increased or decreased by such a variation as aforesaid, and be effective on and from the effective date of the variation but not earlier than the first day of July, one thousand nine hundred and fifty-three.” (c) In subsection two of section six thereof the word “monthly ” is repealed and the word “fortnightly” is inserted in lieu of that repealed word. (d) In Schedule I. thereof— (i.) The figures “ 2125 ” are repealed and the figures “ 2325 ” are inserted in lieu of those repealed figures ; (ii.) The figures “ 1625 ” are repealed and the figures “ 1825 ” are inserted in lieu of those repealed figures. (1.) This Part III. of this Act shall be read as one with *“ The Officials in Parliament Acts, 1896 to 1950.” Collective title. (2.) *“ The Officials in Parliament Acts, 1896 to 1950,” and this Part III. of this Act may be collectively cited as “ The Officials in Parliament Acts, 1896 to 1953.” Amendments 7. *“ The Officials in Parliament Acts, 1896 to 1950,” oNfo6. 03V. ic. are amended as follows :— (a) In section six thereof— (i.) The words “ three thousand and twenty-five ” are repealed and the words “ three thousand two hundred and twenty-five ” are inserted in lieu of those repealed words; (ii.) The words “ two thousand five hundred and seventy-five ” are repealed and the words “ two thousand seven hundred and seventy-five ” are inserted in lieu of those repealed words ; * 60 V. CONSTITUTION. 89 P art III.— 3 Euz. II. No. 19,1954. Governor’s Salary Acts Amendment Acts. A mendments op “T he O ffi cials in P arliament (iii.) The last paragraph is repealed and, in lieu of A cttos , 11985906,” to that paragraph, the following paragraph is inserted, namely:— “ The amount payable for the time being of each and every one of the aforesaid salaries shall be a charge upon and payable out of the Consolidated Revenue Fund of the State which is hereby appropriated accordingly.” (6) The following section is inserted after section six thereof, namely:— “ [6 a .] Section 4 a of *“ The Constitution Act Adjustment Amendment Act of 1896,” shall, with and subject to any of salanes- necessary adaptations thereof, apply with respect to the salaries of the officers declared by this Act capable of being elected members of the Legislative Assembly and accordingly any and every such salary shall be adjustable and shall be adjusted from time to time under, subject to and in accordance with the provisions of the said section 4 a .” An Act to Amend “ The Governor’s Salary Acts, 3 N E o l . iz 1 . 9.
