No. 12 of 1948.

AN ACT to amend sections thirty-seven and thirty- eight of the Constitution Acts Amendment Act, 1899.

[Assented to 11th November, 1948.]

BE it enacted by the King's Most Excellent Majesty,by and with the advice and consent of the Legis-

lative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1.    This Act may be cited as the Constitution Acts Short title.

Amendment Act (No. 1), 1948, and shall be read as one

with the Constitution Acts Amendment Act, 1899 (63 Vict., No. 19), and its amendments, hereinafter referred to as the principal Act.

Amendment of

2.    Section thirty-seven of the principal Act is s. 37.

amended by inserting at the commencement thereof the words "Subject to the second proviso to section thirty- eight of this Act."

3. Section thirty-eight of the principal Act is amended Amendment of s. 38.

by adding at the end thereof -a further proviso as

follows:—

Provided further that, for the purposes of this

and the last preceding section, the holding or

acceptance of the offices following, or either of them, shall not of itself constitute the holding of an office of profit under the Crown or the acceptance of an office of profit from the Crown:—

(a) The office of an approved pharmaceutical chemist under and for the purposes of the Pharmaceutical Benefits Act, 1947, of

the Commonwealth.

(b) The office of a medical practitioner

approved under section eleven of the

said Pharmaceutical Benefits Act, 1947.
