[ASSENTED TO 17TH DECEMBER, 1929.] " l~THEREAS by virtue of an Act intituled t" The Preamble. \' l Oonstitution Act Amendment Act of 1922" (the Bill concerning which was reserved for the signification of His Majesty's pleasure, and in connection with which Bill His Majesty's Assent was proclaimed on the twenty-' third day of March, one thousand nine hundred and twenty-two, and was duly published in the Ga7.-ette of the twenty-seventh day of March, one thousand nine hundred and twenty-two) the Legislative Council was abolished: And whereas it was provided by section three of such Act that the Governor in Council may, by notification published in the Gazette, declare that the existing members of the Legislative Council shall during life, or for such period of time as is fixed in such notification, retain and continue to be entitled to exercise the privilege of a free pass upon the Railways of the State and the use of the parliamentary library, and such other existing privileges of ~ uch members as may be * 00 Vic. No. 26, mentioned in the notification, and that every such notification shall have the same effect as if it were enacted in the aforesaid Act : And whereas by virtue of the said section the following notification, dated the thirtieth day of March, one thousand nine hundred and twenty-two, was pub- lished in the Gazette of the first day of April, one thousand nine hundred and twenty-two, namely:- "His Excellency the Governor, with the advice of the Executive Council, doth hereby notify and declare that every existing Member of the Legislative Council shall during life retain and con11inue to be entitled to exercise- (1) The privilege of a free pass upon the railways of the © State of Queensland; (2) The use of the parliamentary library." And whereas it is considered advisable to amend the law, as hereinafter set forth: Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the ,Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- Short title. 1. This Act may be cited as "The Oonstitution Act Amendment Act of 1929, No. 2," and shall be read as one with *"The Oonstitution Act Amendment Act of 1922," herein referred to as the Principal Act. Definition. 2. In this Act the term" Existing member of the Legislative Council" means a member of the Legislative Council who was a member of the Legislative Council at the date of the Proclamation of His Majesty's assent to the Principal Act. Restriction 3. (1.) From and after the passing of this Act, ~ ~ pr~ es section three of the Principal Act and the notification ex:embers issued thereunder, as hereinbefore set forth in the ~ ~ :~ t' Preamble, shall extend and apply only to those existing counc!l.lve members of the Legislative Council (as hereinbefore defined) who had been members of the said Legislative . Council for a period of not less than seven years prior to the twenty-third day of March, one thousand nine hundred and twenty-two {being the date on which His Majesty's assent to the Principal Act was proclaimed.) * 12 Geo. The free railway pass upon the railways of the ICanc.ellation State, issued pursuant to the notification aforesaid to ! ~ ~ ~ ~ ! ~ ay any existing member of the Legislative Council who was I not a member of the said Legislative Council for a I, period of at least seven years prior to the twenty-third day of March, one thousand nine hundred and twenty- two, is hereby cancelled and determined, and such pass is void accordingly. Any such member concerned shall accordingly i forthwith deliver up and forward to the Commissioner! for Railways, without any further demand other than! the authority of this Act, the free railway pass concerned ! and granted as aforesaid. (3.) The privilege contained in paragraph two of the Curtailment said notification, namely, "the use of the parliamentary ~ ~ ~ ~ ~ e: : e. library," is hereby withdrawn in respect of any existing member of the Legislative Council who was not a member of the said Legislative Council for a period of at least seven years prior to the twenty-third day of March, one thousand nine hundred and twenty-two. (4.) And section three of the Principal Act and the donstruction notification as set forth aforesaid shall be read and ~ ~ i~ c~ p~ 1 construed accordingly. A!ct, and nptification. 4. Nothing in this Act shall prejudice, limit, or S('wing. interfere with any rights or privileges which any existing member of the Legislative Council who was not a member of the said Legislative Council for a period of at least seven years prior to the twenty-third day of March, one thousand nine hundred and twentv-two, but who subsequent to such date became a ~ ember of the Legislative Assembly, shall possess or enjoy as a member of the said Legislative Assembly, and/or as member of the Executive Council.
