CONSTITUTION ACT 1902—PROCLAMATION

NEW SOUTH WALES

by deputation from His Excellency the Governor.

I, Rear Admiral PETER ROSS SINCLAIR, Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 39 of the Constitution Act 1902, do, by this my Proclamation, with effect on and from 1 July 1991:

(a) remove from the Department of Agriculture and Fisheries the Fisheries Division and establish it as an Administrative Office (with the name “Office of Fisheries”) responsible to the Minister for Natural Resources;
(b) change the name of the Department of Agriculture and Fisheries to the “Department of Agriculture”;
(c) remove all branches from and abolish Business and Consumer Affairs and:

(i)  add the following branches to the Department of State Development:

Business Deregulation Policy

Commercial Services Division (except the Business

Land Group and the Co-operatives Unit)

(ii)  add the Business Land Group to the Property Services Group;

(iii)  add the Co-operatives Unit to the Department of Local Government and Co-operatives;

(iv)  add the remaining branches (including the following) to the Department of Consumer Affairs:

Business Licences Administration Centre
Business Licences Information Service
Business Registration (Names and Associations)

Operational Support Division

(d) remove from the Commercial Services Group the Strategic Policy Unit and add it to the Department of Planning;
(e) establish the Department of Conservation and Land Management, as a Department responsible to the Minister for Conservation and. Land Management;
(f) remove all branches from and abolish the Department of Lands and add those branches to the Department of Conservation and Land Management;
(g) remove all branches from and abolish the Soil Conservation Service and add those branches to the Department of Conservation and Land Management;
(h) establish the Department of Consumer Affairs, as a Department responsible to the Minister for Consumer Affairs;

(i)  establish the Department of Courts Administration, as a Department responsible to the Minister of Juctice;

(j)

remove from the Attorney General’s Department the following branches and add them to the Department of Courts Administration:

Court Services Division

Management Division

(k)

remove from the Ministry for the Environment the groups of staff principally involved with the following bodies and establish each of those groups of staff as separate Administrative Offices responsible to the Minister for the Environment:

Bicentennial Park Trust
Centennial Park Trust

Royal Botanic Gardens and Domain Trust

(l)

remove from the Department of Family and Community Services the Juvenile Justice Division and add it to the Department of Corrective Services;

(m)

remove from the Premier's Department the following branches and add them to the Department of Community Services:

Office on Ageing

Office on Disability

(n)

change the name of the Department of Family and Community Services to the "Department of Community Services";

(o)

establish the Office of Health Policy, as an Administrative Office responsible to the Minister for Health;

(p)

remove from the Department of Health the group of staff attached to the Executive Director, Corporate Affairs and add that group of staff to the Office of Health Policy;

(q)

remove from the Department of Health the following branches and add them to the Office of Health Policy:

Strategic Marketing Branch
Government Relations Branch
Corporate Planning Branch
Health Services Development Branch

Commercial Development Branch

(r)

remove from the Attorney General’s Department the group of staff attached to the Government and Related Employees Appeal Tribunal and the Transport Appeal Boards and add that group of staff to the Department of Industrial Relations, Employment, Training and Further Education;

(s)

change the name of the Department of Local Government to the “Department of Local Government and Co-operatives”;

(t)

establish the Office of Energy, as an Administrative Office responsible to the Minister for Energy;

(u)

remove from the Department of Minerals and Energy the following branches and add them to the Office of Energy:

Energy Executive
Energy Resources and Policy Division
Electricity Distribution Division

(v)   change the name of the Department of Minerals and Energy to the

“Department of Mineral Resources”;

(w)

remove from the Attorney General’s Department the Parliamentary Counsel’s Office and establish it as an Administrative Office responsible to the Premier.
