His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Confiscation of Proceeds of Crime Act 1989.

Explanatory note
The object of this Regulation is to declare the Confiscation Act 1997 of Victoria to be a law that corresponds to the Confiscation of Proceeds of Crime Act 1989 of New South Wales and to declare orders in force under the Victorian Act to be interstate orders for the purposes of the New South Wales Act. The Confiscation Act 1997 repealed the Crimes (Confiscation of Profits) Act 1986 of Victoria, which is presently a corresponding law within the meaning of the New South Wales Act.
This Regulation is made under the Confiscation of Proceeds of Crime Act 1989, including the definitions of corresponding law, interstate forfeiture order, interstate pecuniary penalty order and interstate restraining order in section 4 ( 1).

1 Name of Regulation
This Regulation is the Confiscation of Proceeds of Crime
Amendment (Victorian Law) Regulation 1998.

The Confiscation of Proceeds of Crime Regulation 1996 is amended as set out in Schedule 1 .

(Clause 2)
[1] Clause 3 Definitions
Omit the definition of the Victorian Act from clause 3 (1 ) .
Insert instead:the Victorian Act means the Confiscation Act 1997 of
Victoria.
[2] Clause 6 Interstate forfeiture orders: section 4
Omit “section 7” from clause 6 (f).
Insert instead “section 33 or 38”.[3] Clause 7 Interstate pecuniary penalty orders: section 4
Omit ”section 12” from clause 7 (e).
Insert instead “section 59 or 64”.[4] Clause 8 Interstate restraining orders: section 4
Omit “section 16” from clause 8 (f). Insert instead ”section 14”.
