1  Name

This Instrument is the Comptroller-General of Customs (Warrants) Amendment Directions 2017.

2  Commencement

  This Instrument commence on 15 May 2017.

3  Authority

This Instrument is made under section 183UC of the Customs Act 1901.

4  Schedules

The Comptroller-General of Customs (Warrants) Directions 2015 are amended as set out in the applicable items in the Schedule to this instrument, and any other item in the Schedule has effect according to its terms.

Schedule 1—Amendments

1  Section 1.4

Omit “the regional Investigations Division office”, substitute “a regional office of Enforcement Command”.

2  Paragraph 2.1(b)

Omit “the Investigations Division”, substitute “Enforcement Command”.

3  Section 2.2

Omit “the Investigations Division” (wherever occurring), substitute “Enforcement Command”.

4  Section 2.4 (heading)

Repeal the heading, substitute:

Vetting of Enforcement Command applications

5  Section 2.7

Omit “Investigations Division”, substitute “Enforcement Command”.

6  Section 2.8

Omit “Investigations Division” (wherever occurring), substitute “Enforcement Command”.

7  Section 2.9

Omit “Investigations Division (for Investigations Division initiated warrants)”, substitute “Enforcement Command (for Enforcement Command initiated warrants)”.

Repeal the heading, substitute:

Omit “Investigations Division officers”, substitute “officers in Enforcement Command”.

Omit “Investigations Division (for Investigations Division initiated warrants)”, substitute “Enforcement Command (for Enforcement Command initiated warrants)”.

11  After section 4.1

Insert:

5.         Transitional matters

5.1       A reference in these Directions to a warrant applied for by an officer in Enforcement Command, or initiated by Enforcement Command, is to be treated as including a reference to a warrant applied for before commencement of this section by an officer in the Investigations Division, or initiated before the commencement of this section by the Investigations Division.
