822 Companies ( Administration ) Act Amendment Act 1984, No. 72 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Companies (Administration) Act Amendment Act 1984. (2) In this Act the Companies (Administration) Act1981 is referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Companies (Administration) Act1981-1984. 2. Amendment of s. 5. Appointment of Commissioner and other officers. Section 5 of the Principal Act is amended by inserting after subsection (4) the following subsections:- " (4A) During the absence from whatever cause or a vacancy in the office of the Commissioner a person for the time being holding or acting in the office of Deputy Commissioner designated in writing by the Minister shall act in the place of the Commissioner and may exercise and discharge all the powers, authorities, duties and functions of the Commissioner. (4) No person shall be concerned to inquire whether any occasion has arisen requiring or authorizing a Deputy Commissioner to act in the place of the Commissioner and all acts or other things done or omitted by a Deputy Commissioner in the course of so acting shall be as valid and effectual as if they had been done or omitted by the Commissioner.". 3. New s. 10A. The Principal Act is amended by inserting after section 10 the following section:- " 10A. Waiving of f(1) The Commissioner, with the approval of the Governor in Council, may, for and on behalf of the State- (a) waive or reduce, in a particular case or class of case, fees that would otherwise be payable pursuant to an Act to the Commissioner for and on behalf of the State; or (b) refund in whole or in part, in a particular case or class of case, fees paid pursuant to an Act to the Commissioner for and on behalf of the State. (2) The power under subsection (1) may be exercised in respect of fees paid or payable before the commencement of the Companies (Administration) Act Amendment Act 1984 as well as in respect of fees paid or payable on or after that date.".
