s1 2 s4 Community Services (Aborigines) Amendment (No. 1) No. 82, 1997 ˙ Short title 1. This regulation may be cited as the Community Services (Aborigines) Amendment Regulation (No. 1) 1997 . ˙ Regulation amended 2. This regulation amends the CommunityServices(Aborigines)Regulation 1985 . ˙ Amendment of s 5 (Interpretation) 3. Section 5— insert— ‘ “conclusion” , of an election for an Aboriginal council, see section 5A. ˙ Insertion of new s 5A 4. After section 5— insert— ˙ ‘ Meaning of “conclusion” of election for Aboriginal council ‘ 5A. The “conclusion” of the election of a councillor is— (a) if the councillor is elected at an election of all councillors of the Aboriginal council—the day on which the last declaration of a poll conducted in the election is displayed as required under this regulation; or (b) if the councillor is elected at a by-election and— (i) a poll is conducted—the day on which the declaration of the poll is displayed as required under this regulation; or (ii) a poll is not conducted—the day after the nomination day for the by-election; or (c) if, because the number of candidates nominated for election is the same or less than the number of councillors to be elected, the councillor is elected (other than at a by-election) and—
s5 3 s6 Community Services (Aborigines) Amendment (No. 1) No. 82, 1997 (i) 1 or more polls are conducted in the council’s area—the day on which the last declaration of a poll is displayed as required under this regulation; or (ii) a poll is not conducted—6 p.m. on the day that a poll would otherwise have been required under this regulation to be conducted.’. ˙ Amendment of s 34 (Dissolution of council and appointment of administrator) 5. Section 34(3)— omit, insert— ‘ (3) The appointment ceases on the conclusion of the fresh election of the councillors for the council to be held on 21 June 1997. ‘ (4) This section expires on 1 July 1997.’. ˙ Insertion of new s 35 6. After section 34— insert— ˙ ‘Direction for fresh election for Woorabinda Aboriginal Council ‘ 35.(1) A fresh election for the councillors of Woorabinda Aboriginal Council must be held on 21 June 1997. ‘ (2) This section expires on 1 July 1997’.
