COMMUNITY SERVICE ORDERS ACT 1979—REGULATION

(Relating to extension of fine default community service orders)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Community Service Orders Act 1979, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 1st April, 1991.

Amendments

2. The Community Service Orders Regulation 1988 is amended:

(a) by inserting after clause 14 the following clause:

Extension of fine default orders

15. (1) For the purposes of section 26H (2) and (3) of the Act:

(a)

an application for the extension of a community service order may be made in Form 9; and.

(b) an extension of the order may be in Form 10.

(2) A copy of the extension of a community service order under section 26H of the Act is to be served personally or by post on the person in respect of whom the community service order was made.

(b) by inserting after Form 8 in Schedule 1 the following forms:

EXPLANATORY NOTE

The object of this Regulation is to amend the Community Service Orders Regulation 1990 to prescribe the form in which an application for extension of a fine default community service order may be made and the form in which the extension may be given.
