Amendment Regulations 2021

Made by the Governor in Executive Council.

1.           Citation

These regulations are the Community Protection (Offender
Reporting) Amendment Regulations 2021.

2.           Commencement

These regulations come into operation as follows -

(a)	regulations 1 and 2— on the day on which these regulations are published in the Gazette (gazettal day);
(b)	regulations 3 and 5(1) - on the day after gazettal day;
(c)	the rest of the regulations - on the day on which the Road Traffic Amendment (Impaired Driving and Penalties) Act 2020 section 37 comes into operation.

3.           Regulations amended

These regulations amend the Community Protection (Offender
Reporting) Regulations 2004.

defined in the Road Traffic Act 1974 section 65.

4.            Regulation 3 amended

In regulation 3 delete the definition of self-testing breath analysing equipment.

5.            Regulation 26D amended

(1)	Delete regulation 26D( 1) and insert:
(1) In this regulation - authorised breath tester means an authorised person as

(2)	Delete regulation 26D(3) and insert:
(3) A sample of a reportable offender's breath may only be tested for the purposes of a breath test by breath testing equipment that is operated in accordance with the instructions set out in the Breath Analysis Regulations Schedule 2.
(3)	Delete regulation 26D(6), (7) and (8).

6.             Regulation 26J deleted

Delete regulation 26J.

7.             Schedule 1 Form 4 deleted

Delete Schedule 1 Form 4.
