Community and Health Service Regulations2 (Amendment)

I, GARY FRANCIS PUNCH, the Minister of State for the Arts and Territories, pursuant to section 8 of the Interpretation Ordinance 1967, hereby make the following Regulations under the Community and Health Service Ordinance 1985.

Principal Regulations

1.  In these Regulations, “Principal Regulations” means the Health Commission Regulations.

Substitution

2.  Regulations 1 and 2 of the Principal Regulations are repealed and the following regulations substituted:

Citation

“1. These Regulations may be cited as the Community and Health Service Regulations.

Interpretation

“2.  In these Regulations, ‘the Ordinance’ means the Community and Health Service Ordinance 1985.”.

Notice of direction under subsection 58 (4) or (5)

3.  Regulation 4 of the Principal Regulations is amended by omitting “sub-section 41 (3) or 41 (4)” and substituting “subsection 58 (4) or (5)”.

Repeal

4.  Regulation 5 of the Principal Regulations is repealed.

Notice of promotion

5.  Regulation 6 of the Principal Regulations is amended by omitting “by the display, in a prominent place at each hospital conducted by the Commission, of” and substituting “by publishing in a newsletter or similar publication which is regularly published by or on behalf of the Service and distributed among the staff members of the Service,”.

Appeal against promotion

6.  Regulation 7 of the Principal Regulations is amended by omitting from paragraph (b) “Chairman of the Commission” and “displayed” and substituting “General Manager” and “published” respectively.

Appeals under section 67

7.  Regulation 8 of the Principal Regulations is amended—

(a)by omitting subregulation (1) and substituting the following subregulation:

“(1)  In this regulation—

‘appeal’ means an appeal under section 67 of the Ordinance;

‘Board’ means a Staff Appeals Board constituted for the purposes of Division 5 of Part VII of the Ordinance;

‘Chairperson’ means the Chairperson of a Staff Appeals Board.”;

(b)by omitting from subregulation (2) “Chairman of the Commission” and substituting “General Manager”;

(c)by omitting from subregulation (3) “is notified” and “Commission” and substituting “receives notice in writing” and “Service” respectively;

(d)by omitting from subregulation (4) “Chairman of the Commission” and substituting “General Manager”;

(e)by omitting from paragraph 4 (a) “Chairman” and “Chairman of the Staff Appeals Board” and substituting “General Manager” and “Chairperson” respectively;

(f)by omitting from paragraphs (4) (b) and (c) “Chairman” and substituting “Chairperson”;

(g)by omitting from subregulations (6), (9), (10), (11) and (13) “Staff Appeals”;

(h)by omitting from subregulation (7) “Chairman of the Staff Appeals Board” and “Commission” and substituting “Chairperson” and “Service” respectively;

(i)by omitting from paragraph (8) (b) “Chairman” and substituting “Chairperson”; and

(j)by omitting from subregulation (11) “Chairman of the Board” and substituting “Chairperson”.
