FAIR WORK AUSTRALIA

DECISION

Fair Work Act 2009
s.437—Protected action

Communications, Electrical, Electronic, Energy, Information, Postal, Plumbing and Allied Services Union of Australia
v
Landis & Gyr Pty Ltd
(B2012/903)

COMMISSIONER RYAN

MELBOURNE, 22 JUNE 2012

Proposed protected action ballot by employees of Landis & Gyr Pty. Ltd.

[1] This is an application for a protected action ballot of members of Communications, Electrical, Electronic, Energy, Information, Postal, Plumbing and Allied Services Union of Australia (CEPU) employed by Landis & Gyr Pty Ltd (Landis & Gyr).

[2] This application was filed by the AMWU on 21 June 2012.

[3] In response to an emailed enquiry sent from my Chambers, Ms Alexandra Stathatos, Manager Human Resources, of Landis & Gyr advised in writing on 21 June 2012 that the employer does not oppose the application by the CEPU and does not wish to be heard in relation to it.

[4] In the circumstances I have decided to determine the matter on the papers without holding a hearing.

[5] I am satisfied that the requirements in s.443(1) of the Act have been met and that, accordingly, an order must be made. An order based on the draft order provided by the CEPU has issued in conjunction with this decision.
