Proposed protected action ballot by employees of KLM Group Pty Ltd (Tasmania).

[1] This is an application for a protected action ballot of members of the Communications, Electrical, Electronic, Energy, Information, Postal, Plumbing and Allied Services Union of Australia (CEPU) employed by KLM Group Pty Ltd (Tasmania).

[2] James O’Neill and Associates, representing the employer, advised by email on 14 September 2012 that KLM Group Pty Ltd (Tasmania) does not oppose the application.

[3] In the circumstances I have decided to determine the matter on the papers without holding a hearing.

[4] I am satisfied that the requirements in s.443(1) of the Act have been met and that, accordingly, an order must be made. An order based on the draft order provided by the CEPU has issued in conjunction with this decision.
