Alteration of other rules of organisation.
On 6 December 2018, the Communications, Electrical, Electronic, Energy, Information, Postal, Plumbing and Allied Services Union of Australia (CEPU) lodged with the Fair Work Commission a notice and declaration setting out particulars of alterations to the rules of the Plumbing Division of the CEPU – Section C (the Divisional Rules).
The particulars set out alterations to the following Divisional Rules:
· 48 – Management of Branches;
· 49 – Branch Elections.
The alterations, if certified, will have three primary effects.
Firstly, Branch Organisers will no longer form part of the Committee of Management of a Divisional Branch on and from the next quadrennial elections.
Secondly, more than one office of Assistant Branch Secretary may be established within a Divisional Branch on and from the next quadrennial elections.
Finally, the period of financial membership required in order to nominate for the following offices will be increased from at least 12 months to at least 24 months:
· Federal Vice President;
· Federal Councillor;
· Branch Secretary; and
· Assistant Branch Secretary.
The period of financial membership required in order to nominate for the remaining offices within a Divisional Branch will remain 12 months prior to the relevant nomination.
On the information contained in the notice, I am satisfied the alterations have been made under the rules of the organisation.
In my opinion, the alterations comply with and are not contrary to the Fair Work (Registered Organisations) Act 2009, the Fair Work Act 2009, modern awards and enterprise agreements, and are not otherwise contrary to law. I certify accordingly under subsection 159(1) of the Fair Work (Registered Organisations) Act 2009.
