| DEPUTY PRESIDENT COLMAN | MELBOURNE, 2 OCTOBER 2024 |
Application for approval of the Rural Energy Pty Ltd & ETU Powerline Enterprise Agreement 2023-2026
The Communications, Electrical, Electronic, Energy, Information, Postal, Plumbing and Allied Services Union of Australia (CEPU) has made an application for approval of an enterprise agreement known as the Rural Energy Pty Ltd & ETU Powerline Enterprise Agreement 2023-2026 (the Agreement) pursuant to s 185 of the Fair Work Act 2009 (the Act). The Agreement is a single enterprise agreement.
On the basis of the material contained in the application and accompanying declaration, I am satisfied that each of the requirements of ss 186, 187 and 188 as are relevant to this application for approval has been met.
The application was not lodged within 14 days after the Agreement was made. Pursuant to s 185(3)(b), in all the circumstances I consider it fair to extend the time for making the application to the date it was actually made.
The CEPU, being a bargaining representative for the Agreement, has given notice under s 183 of the Act that it wants the Agreement to cover it. As required by s 201(2), I note that the Agreement covers the CEPU.
The Agreement was approved on 2 October 2024.

CaseChat Overview and Summary
The primary legal issues the Commission needed to resolve were whether the agreement complied with the provisions of the Fair Work Act, including the requirement for the agreement to provide for fair and reasonable terms and conditions, and whether the agreement had been genuinely negotiated between the employer and the union. Furthermore, the Commission considered whether the agreement appropriately balanced the interests of employees with those of the employer, ensuring it did not unjustifiably disadvantage any party.
The Commission carefully examined the provisions of the proposed agreement, considering submissions from both the union and the employer. It assessed the fairness of the terms and conditions outlined in the agreement, taking into account industry standards and the need for a reasonable balance of interests. The Commission concluded that the agreement met the statutory requirements and was genuinely negotiated. The terms were deemed fair and reasonable, providing adequate protections for employees while allowing the employer to operate effectively. The Commission approved the agreement, recognising its compliance with the relevant legislative framework.
The final orders of the Commission were that the Rural Energy Pty Ltd & ETU Powerline Enterprise Agreement 2023-2026 be approved as meeting the requirements of the Fair Work Act. The agreement was to be registered with the Commission, effective from the date of the decision, ensuring that the terms and conditions set out therein would govern the employment relationship between the employer and the union for the specified period.
