CaseChat Overview and Summary
The legal issues before the Commission were whether the agreement was a genuine enterprise agreement and whether it complied with the requirements of the Fair Work Act 2009. The union argued that the agreement was a genuine enterprise agreement and complied with the Act. The Commission had to consider the evidence presented by both parties and determine whether the agreement met the statutory requirements.
The Commission found that the agreement was a genuine enterprise agreement that complied with the Act. The union had demonstrated that it had a genuine enterprise agreement with the employer, and that the agreement had been negotiated in good faith. The Commission also found that the agreement met the statutory requirements, including the provision of adequate protections for employees. The Commission approved the agreement and registered it on the Register of Approved Agreements.
The final orders of the Commission were that the Profire Qld Pty Ltd - Major Commercial Fire Services - Union Greenfield Agreement 2011-2015 be approved and registered on the Register of Approved Agreements. The agreement would now apply to the employees of Profire Qld Pty Ltd in the major commercial fire services industry, providing them with the terms and conditions of employment set out in the agreement.
