CaseChat Overview and Summary

In the Fair Work Commission, the Communications, Electrical, Electronic, Energy, Information, Postal, Plumbing and Allied Services Union of Australia (the Union) applied for the approval of the Hanna Bros Plumbing Pty Ltd & CEPU Plumbing Division - NSW Branch Plumbing Enterprise Agreement 2015-2019. The agreement was to apply to employees who are currently employed by Hanna Bros Plumbing Pty Ltd, or who are subsequently engaged by that employer. The Union argued that the enterprise agreement, which was made under section 234 of the Fair Work Act 2009, was a "better off overall" agreement when compared to the applicable awards. Hanna Bros Plumbing Pty Ltd did not object to the application, and the only other party to make submissions was the Australian Building and Construction Commission, which did not object to the application. The issue before the Commission was whether the enterprise agreement was a "better off overall" agreement. The Union submitted that the agreement provided for a range of benefits to employees, and the Commission noted that it contained a significant number of provisions that improved upon the applicable awards, particularly in relation to penalty rates. The Commission also noted that the agreement contained a number of provisions that provided for a degree of flexibility in the workplace, which was a benefit to the employer. The Commission held that the agreement was a "better off overall" agreement, and approved it accordingly. The Commission made an order approving the enterprise agreement, and the parties are bound by it.
