CaseChat Overview and Summary
The legal issues before the Commission included whether the agreement contained all the mandatory terms required by the Fair Work Act, and whether it was made in good faith and without coercion. The Commission had to consider the fairness and reasonableness of the agreement's terms and conditions, including wages, hours of work, and other employment-related matters. Additionally, the Commission examined whether the agreement complied with the 'better off overall test', ensuring that employees were not worse off under the new agreement compared to their previous conditions.
In delivering its decision, the Fair Work Commission found that the agreement largely complied with the statutory requirements. The Commission noted that while some minor procedural issues were present, these did not significantly impact the overall fairness of the agreement. The terms of the agreement were deemed reasonable and in good faith, and it was concluded that employees would be better off overall under the new conditions. Consequently, the Commission approved the application for the agreement's registration, confirming its compliance with the necessary legislative standards.
The final orders of the Commission included the approval and registration of the S.J. Electric (Vic) Pty. Ltd. and ETU Enterprise Agreement 2017-2021, effective from the date of the decision. The agreement was to be binding on all employees covered by its terms, and the Commission directed that the necessary steps be taken to ensure its implementation in accordance with the Fair Work Act.
