CaseChat Overview and Summary
The legal issues that the Commission was required to address involved whether the agreement met the requirements of the Fair Work Act 2009, including whether it was a “direct substitution” agreement, and whether it contained the minimum terms and conditions that the Act requires. The Commission had to determine whether the agreement was in the best interests of the employees covered by it, and whether it met the “better off overall test”. The Commission also needed to consider whether the agreement was free from any unlawful content.
The Commission found that the agreement was a direct substitution agreement, which meant that it replaced any existing enterprise agreement between the parties. The Commission noted that the agreement contained all the required minimum terms and conditions, and that it was in the best interests of the employees covered by it. The Commission was satisfied that the agreement met the better off overall test, and that it was free from any unlawful content. The Commission approved the agreement, noting that it provided a fair and reasonable outcome for both the employees and the employer.
