CaseChat Overview and Summary

The Communications, Electrical, Electronic, Energy, Information, Postal, Plumbing and Allied Services Union of Australia sought approval of the Complete Fire Protection Pty Ltd & CEPU NSW/NFIA Sprinkler Fitting Fire Protection Union Enterprise Agreement NSW & ACT 2020-2024. The matter was heard in the Fair Work Commission. The union argued that the agreement should be approved as it fairly reflected the terms and conditions of employment for the employees covered by the agreement. Conversely, the employer contended that certain provisions of the agreement should not be approved as they were overly restrictive and detrimental to the business.

The key legal issues for the court to determine were whether the agreement complied with the requirements of the Fair Work Act 2009 and whether the provisions were fair and reasonable. The court had to consider the principles of good faith bargaining, the requirement for the agreement to provide for minimum rates of pay, and the overall fairness of the agreement's provisions.

The court found that the agreement generally complied with the Fair Work Act and provided for minimum rates of pay. However, certain provisions were found to be overly restrictive and not in the best interests of the employees or the employer. The court exercised its discretion to modify the agreement by removing the overly restrictive provisions, finding that the modified agreement was fair and reasonable. The court approved the agreement with the modifications.

The court's final order was that the Complete Fire Protection Pty Ltd & CEPU NSW/NFIA Sprinkler Fitting Fire Protection Union Enterprise Agreement NSW & ACT 2020-2024, as modified, was approved. The modifications included the removal of certain overly restrictive provisions that were found to be detrimental to the business and not in the best interests of the employees or the employer.
