Application for approval of the Comms Aust No1 (CA) Field Technical Agreement 2016.

[1] An application has been made for approval of an enterprise agreement known as the Comms Aust No1 (CA) Field Technical Agreement 2016 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by Comms Aust No1 Pty Ltd T/A Comms Aust No1. The Agreement is a single enterprise agreement.

[2] The Applicant has provided written undertakings. A copy of the undertakings is attached in Annexure A. I am satisfied that the undertakings will not cause financial detriment to any employee covered by the Agreement and that the undertakings will not result in substantial changes to the Agreement.

[3] Subject to the undertakings referred to above, I am satisfied that each of the requirements of ss.186, 187, 188 and 190 as are relevant to this application for approval have been met.

[4] Pursuant to s.205(2) of the Act, the model consultation term prescribed by the Fair Work Regulations 2009 is taken to be a term of the Agreement.

[5] The Agreement is approved and, in accordance with s.54 of the Act, will operate from 12 June 2017. The nominal expiry date of the Agreement is 31 March 2019.

Appendix B

CLASSIFICATIONS AND RATES OF PAY

Classification	Minimum hourly rate of pay as at 1 March 2016	Description
Level 1 Technician	$25.00	An employee who has completed an AQF Certificate in Telecommunications or similar field; or an employee who has completed 4 years of work as a Technician and received on the job training by a Senior Technician An employee who can carry out the majority of duties of a Technician under direction and supervision of a Senior Technician.
Level 2 Technician	$28.00	An employee who has met the conditions of a Level 1 Technician but can carry out the majority of duties of a Technician with limited supervision and guidance by a Senior Technician.
Senior Technician	$32.00	An employee who can competently carry out the full range of duties of a Technician and provide guidance to Level 1 and 2 Technicians.
Product Specialist	$38.00	An employee who has advanced knowledge and can competently carry out the full range of duties of a Senior Technician as well as provide guidance and direction to Technicians.
