I, JOSEPH LUDWIG, Minister for Human Services, make this Direction under subsection 8(1)(c) of the Commonwealth Services Delivery Agency Act 1997.

  1. Name of Direction

This Direction is the Commonwealth Services Delivery Agency (Functions of the Chief Executive Officer) Direction 2009.

  1. Commencement

This Direction commences on the day it is registered.

  1. Definitions

In this Direction:

Act means the Commonwealth Services Delivery Agency Act 1997.

Case management service means providing, arranging for the provision of, or co-ordinating the provision of, any of the following services to an individual:

(a)   social services;

(b)   health and allied health services;

(c)   support services;

(d)   rehabilitation services;

(e)   education services;

(f)     accommodation services;

(g)   advocacy services;

(h)   financial advisory services.

Customer identity service means the service of assisting an individual to obtain an identity document, or obtaining an identity document on behalf of a person.

Emergency means an emergency or disaster in Australia or an emergency or disaster outside Australian that involves one or more Australian citizens and includes an emergency or disaster that has been the subject of a declaration under section 80J or 80K of the Privacy Act 1988.

Government document means any document routinely issued by a Commonwealth authority, a State authority, a local government body or a government of a foreign country.

Identity document means, in relation to an individual, a government document issued or that could be issued to that individual that relates to the identity, qualifications, entitlement or status of the individual and includes a driver’s licence, a birth certificate, a marriage certificate and a passport.

State authority means a State or Territory, or a body established for a public purpose by or under a law of a State or Territory.

  1. Direction to perform case management service function

a.The Chief Executive Officer is directed under section 8(1)(c) of the Act to provide a case management service to an individual who has been affected by an emergency.

b.Without limiting paragraph 4(a), the Chief Executive Officer may perform the function in paragraph 4(a):

(i)on behalf of a State authority;

(ii)under an arrangement with a State authority;

(iii)under an arrangement with the government of a foreign country;

(iv)under an arrangement with a non-government organisation.

  1. Direction to perform the customer identity function

(a)The Chief Executive Officer is directed under section 8(1)(c) of the Act to provide the customer identity service to an individual who has been affected by an emergency and who requests the Chief Executive Officer to provide the service.

(b)Without limiting paragraph 5(a), the Chief Executive Officer may perform the function in paragraph 5(a):

(i)under an arrangement with a State authority;

(ii)under an arrangement with the government of a foreign country;

(iii)under an arrangement with a non-government organisation.

  1. Individuals affected by an emergency

In this Direction, an individual is taken to be affected by an emergency if they are directly or indirectly affected by an emergency or if a member of the individual’s family has been affected by an emergency.
