Consequently, the appeal was allowed. The judgment of the District Court was set aside, and judgment was entered for the defendant (the appellant) with costs. The respondent was ordered to pay the costs of the appeal, with a certificate under the Suitor's Fund Act 1951 available to them. The respondent's Notice of Motion was also dismissed with costs.
