Commonwealth Scholarship Regulations (Amendment) (Cth)
STATUTORY RULES.
REGULATIONS UNDER THE EDUCATION ACT 1945.*
I, THE
GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the
advice of the Federal Executive Council, hereby make the following Regulations
under the

Amendments of the Commonwealth Scholarship Regulations.
(
a ) by inserting in sub-regulation (1.), after the word “Commission” (first occurring), the words “or an authorized officer”; and(
b ) by omitting sub-regulations (3.) and (4.) and inserting in their stead the following sub-regulations:—“(3.) A student whose application for a scholarship is successful shall be awarded—
(
a ) in the case of a student who attained the age of twenty-five years before the first day of January in the year in which he is first awarded a scholarship—a mature age scholarship; or(
b ) in any other case—an ordinary scholarship.“(4.) The number of scholarships to be awarded, the number to be awarded to students in any of the classes specified in the Schedule to these Regulations, the methods and standards of selection of students to whom scholarships are to be awarded and the conditions subject to which scholarships are to be held shall be as the Commission determines.”.

(
a ) by omitting from paragraph (a ) of sub-regulation (2.) the words “One hundred and thirty pounds” and inserting in their stead the words “One hundred and sixty-nine pounds”;(
b ) by omitting from paragraph (b ) of sub-regulation (2.) the words “One hundred and ninety-five pounds” and inserting in their stead the words “Two hundred and forty pounds ten shillings”; and(
c ) by omitting paragraphs (c ), (d ) and (e ) of sub-regulation (2.) and inserting in their stead the following paragraphs:—“(
c ) an amount calculated at the rate of—(i) in the case of a student who is the brother or sister of a full-time student of a class specified in the Schedule to these Regulations—Two pounds; or
(ii) in any other case—Three pounds
for every Ten pounds by which the adjusted family income of the holder of the scholarship exceeds Six hundred pounds;
“(
d ) the greater of the following amounts:—(i) the amount by which money earned or received by him in the long vacation, from all sources (including income from investments, property, employment and any other award), calculated at a weekly rate and computed week by week, exceeds Four pounds ten shilling’s per week; or
(ii) the amount by which money received by him in the long vacation, from all sources other than employment, calculated at a weekly rate and computed week by week, exceeds One pound ten shillings per week; and
“(
e ) the amount by which money earned or received by him in term and in the short vacations, from all sources (including income from investments, property, employment and any other award), calculated at a weekly rate and computed week by week, exceeds One pound ten shillings per week.”; and(
d ) by omitting sub-regulations (4.), (5.) and (6.) and inserting in their stead the following sub-regulations:—“(4.) In this regulation, ‘adjusted family income’, in relation to a student, means the total of the gross incomes received by the parents of the student during the year ended on the thirtieth day of June next preceding the year in
respect of which he has applied for benefits less the deductions allowable under the
Income Tax and Social Services Contribution Assessment Act 1936-1955 for losses and outgoings incurred in gaining or producing assessable income within the meaning of that Act and an amount of—(
a ) One hundred pounds for the first child; and(
b ) Fifty pounds for each other child,other than the student, who is under the age of sixteen years and is wholly or partly dependent upon his parents or either of them.
“(5.) In calculating the adjusted family income of a student the amount of the income, or part of the income, of any parent of the student may, at the discretion of the Commission, be deemed not to be part of the adjusted family income of the student.
“(6.) Notwithstanding the preceding provisions of this regulation, a full-time student who has been awarded an ordinary scholarship and has attained the age of twenty-five years may, in respect of each year during which he remains a full-time student after attaining that age, be granted a living allowance calculated in accordance with the next succeeding Division.”.
(
a ) by omitting paragraph (a ) of sub-regulation (2.) and inserting in its stead the following paragraph:—“(
a ) Two hundred and forty pounds ten shillings per annum; and”;(
b ) by omitting from sub-paragraph (i) of paragraph (b ) of sub-regulation (2.) the words “One pound four shillings” and inserting in their stead the words “One pound eleven shillings”;(
c ) by omitting from paragraph (d ) of sub-regulation (2.) the words “One pound ten shillings” and inserting in their stead the words “Two pounds five shillings”; and(
d ) by omitting from paragraph (e ) of sub-regulation (2.) the words “Three pounds” and inserting in their stead the words “Four pounds ten shillings”.
“18. The maximum amount which may be paid by way of living allowance in any one year shall not exceed—
(
a ) in the case of a holder of an ordinary scholarship other than a full-time student to whom sub-regulation (6.) of regulation 13 of these Regulations is applicable—the amount specified in whichever of paragraphs (a ) and (b ) of sub-regulation (2.) of regulation 13 of these Regulations is applicable to the student; and(
b ) in the case of a holder of a mature age scholarship or a holder of an ordinary scholarship to whom sub-regulation (6.) of regulation 13 is applicable—the amount ascertained in accordance with paragraphs (a ), (b ) and (c ) of sub-regulation (2.) of regulation 14 of these Regulations.”.

b ) by omitting from paragraph (b ) the words—“Law (Final Certificate),”;
(
c ) by inserting in paragraph (d ), after the Word—“Engineering,”,
the words—
“Food Technology,”;
(
d ) by inserting in paragraph (d ), after the words—“Manual Arts,”,
the words—
“Music (at standards approved by the Commission),”; and
(
e ) by inserting in paragraph (d ), after the word—“Optometry,”,
the word—
“Orthoptics.”.
