REGULATION UNDER THE COMMONWEALTH PUBLIC SERVICE ACT 1902-1911.

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulation under the Commonwealth Public Service Act 1902-1911 to come into operation forthwith. Such Regulation shall supersede the Provisional Regulation (Statutory Rules 1913, No. 35) under the said Act made on the 1st day of March, One thousand nine hundred and thirteen.

Regulation 104, made under the provisions of the Commonwealth Public Service Act 1902, is repealed, and a new Regulation in the following terms is made in lieu thereof :—

104. The General Division shall be arranged in grades as set forth in the First Schedule to this Regulation. Except where otherwise provided the limits of salary to be paid an officer occupying any office designated in the Second Schedule to this Regulation shall be those prescribed therein in respect to such office. The Governor-General may from time to time, upon the recommendation of the Commissioner, create any office in the General Division not designated in the Second Schedule, and may fix the grade in which the officer occupying such office shall be placed and the limits of salary for such office, or may raise the grading of any office and fix the limits of salary for such office, and thereupon the Second Schedule shall be deemed to have been amended by the inclusion of the office so created or raised.

(a) No increments are provided in these grades. Salary within the limits of the grades will be such as may be determined from time to time by the Commissioner.

Notwithstanding anything contained in the foregoing, officers 21 years of age and over shall be paid salary at the rate of £110 per annum if occupying positions of Boy on Launch, Female Assistant (printing), Female Assistant (quarantine), Messenger, Pensions Receipt Sorter, Notes Sorter, or Telephonist, and at the rate of £126 per annum if occupying any other position in Grade I. or II. designated in the foregoing Schedule, but the payment of such salary under this provision shall not be taken into consideration for purposes of seniority or future advancement.

Except where otherwise provided advancement from grade to grade shall be dependent upon the occurrence of vacancies in the higher grades, or upon alteration of the classification of an office.

 

The grade of an officer under the provisions of this Regulation shall be that corresponding to his designation, provided that when the same designation occurs in two or more grades, the grade of the officer shall be that corresponding to the rate of salary received by him prior to the issue of this Regulation.

Notwithstanding anything in the Schedules contained in this Regulation in any case where the Governor-General, on the recommendation of the Commissioner, directs that an office shall be classified in any particular grade, the officer occupying such office may, subject to the approval of the Commissioner, be advanced to the minimum salary of such grade.

Notwithstanding anything contained in this Regulation in any case where an increment to an officer would be deferred, owing to the provisions of this Regulation, beyond the date on which it would have accrued under the provisions of a previous Regulation, the Commissioner may grant the increment from such date.
