REGULATIONS UNDER THE COMMONWEALTH PUBLIC SERVICE ACT 1922-1924.

THE BOARD OF COMMISSIONERS appointed under the Commonwealth Public Service Act 1922-1924, in pursuance and exercise of the authority conferred upon it by the said Act, and subject to the approval of the Governor-General, hereby makes the following amendments of the Regulations, such amendments to come into operation forthwith, except amendments (e) and (f) of Regulation 106, which are to come into operation as from the 1st July, 1926.

AMENDMENTS OF COMMONWEALTH PUBLIC SERVICE REGULATIONS.

(Statutory Rules 1926, No. 212, as Amended to this Date).

1. Regulation 2 is amended by inserting, after the words “Part VI.—Officers of the Fourth Division”, the following words:—

“Part VI a.—Variation of Salary—Officers of Second, Third, and Fourth Divisions.”

2. Sub-regulation (1) of regulation 49 is repealed.

3. Regulation 86 is amended by omitting sub-regulation (1) and inserting in its stead the following sub-regulation:—

“(1) In addition to the salary paid under these Regulations or under any determination made under the Arbitration

(Public Service) Act 1920, there shall be payable to each officer who is in receipt of salary less than £500 per annum, and who is married or a widower or widow, and is the father or step-father or mother or step-mother of any child under the age of fourteen years and dependent upon and maintained by the officer—an allowance of £13 per annum in respect of each such child so dependent and maintained. A similar allowance may, on the approval of the Board, be granted to any officer in respect of any orphan or adopted child under the age of fourteen years who is dependent upon and maintained by that officer:

Provided that the total sum per annum paid to any officer under this sub-regulation shall not exceed the amount by which the salary per annum of the officer falls short of £500.”

4. Regulation 105 is amended—

(a) by inserting in paragraph (b) of sub-regulation (4) the following additional clause:—

“(v) in the case of any officer receiving, salary not less than £1,000, of an amount of £50.”

(b) by adding at the end of Table A the figures “1,050 1,100”.

(c) by adding at the end of Table C the figures “1,050 1,100”

5. Regulation 105a is amended—

(a) by inserting in paragraph (i) after “£402 per annum” the words “or receive further incremental advancement”.

(b) by inserting in paragraph (l) after “£402” per annum the words “or receive further incremental advancement”.

6. Regulation 105b is amended by inserting in the table, after the office of Postmistress, Grade 4, the following particulars:—

7. Regulation 105c is amended—

(а) by inserting in sub-regulation (2), after the word “next”, the words “the Postmaster or”.

(b) by inserting in sub-regulation (2), after the words “Telegraphist-in-charge”, the words “as the case may be”

 

(c) by omitting from sub-regulation (2) the words “ and Eucla and Israelite Bay ”, and inserting in their stead the words “and Cue and Marble Bar”.

8. The heading immediately preceding regulation 106 is amended by inserting before the word “Officers” the following word and figures:—“Part VI.”.

9. Regulation 106 is amended—

An officer occupying an office of Postal Clerk, Fourth Division, shall, upon notification in the Gazette of his having passed an examination prescribed for transfer to the Third Division, become an officer of the Third Division as from the date of that notification, and shall thereupon be eligible, subject to the provisions of regulation 105, for advancement to a maximum salary of £306 per annum

An officer occupying an office of Postal Clerk (Female), Fourth Division, shall, upon notification in the Gazette of her having passed an examination prescribed for transfer to the Third Division, become an officer of the Third Division as from the date of that notification, and shall thereupon be eligible, subject to the provisions of regulation 105 for advancement to a maximum salary of £258 per annum

* A Postal Clerk or Postal Clerk (Female) who at or subsequent to 30th June, 1924, was classified as a senior Postal Assistant shall be eligible to receive two further increments of £12.

10. The following heading is inserted immediately preceding regulation 106a:—

“Part VI a.—Variation of Salary—Officers of Second, Third, and Fourth Divisions.”

11. Regulation 106b is repealed.

12. Regulation 112 is amended—

(a) by inserting in sub-paragraph (i) of paragraph (a) of sub-regulation (1), after the word “register”, the following words and figures:—

“or he was a successful candidate at Examination No. 782, held in November; 1918”.

(b) by omitting paragraph (b) of sub-regulation (2) and inserting in its stead the following paragraph:—

“(b) An officer shall not be eligible for transfer from the Fourth to the Third Division until he attains such age, not less than sixteen years, as the Board determines and notifies in the Gazette, and, except in the case of—

(i) returned soldiers,

(ii) any officer specified in sub-paragraph (ii), (iii)or (iv) of the last preceding sub-regulation;

(iii) any officer who qualified for transfer to the Third Division by examination notified before 16th January,1925; and

(iv) such officers as the Board specifies by notification in the Gazette,

an officer, after attaining the age of thirty years shall not be eligible for transfer from the Fourth to the Third Division.”

13. Regulation 112a is amended—

(a) by inserting in sub-regulation (1), after the words “Postal Assistant'”, the words and figures “Grades 2 and 3”.

(b) by inserting in sub-regulation (1), after the word “position”, the following words—

“and upon his being within the age limits notified as a condition of such test or examination”

 

14. After regulation 112d the following regulation is inserted:—

Salaries of Fourth Division Officers previously temporarily employed.

113. (1) The following conditions shall apply to any person temporarily employed at the date of his permanent appointment to a Fourth Division position which has status similar to that of his temporary position:—

(a) If he is in receipt of pay above the minimum rate prescribed for a permanent officer of like position, he shall be appointed without diminution of pay, and shall, if not in receipt of the maximum salary of his position, be eligible for incremental advancement, subject to the usual conditions governing the granting of increments, twelve months from the date of receipt of pay drawn as a temporary employee at the time of his permanent appointment; and

(b) If he is in receipt of the minimum salary of the position he shall be eligible for incremental advancement, subject to the usual conditions governing the granting of increments on the following basis:—

(i) If he has had less than twelve months’ temporary service—increment to be granted twelve months from the date of his permanent appointment; and

(ii) If he has had twelve months’ temporary service but less than two years’ temporary service—increment to be granted from the date of completion of two years’ combined temporary and permanent service.

(2) Where a temporary employee is permanently appointed to a position in the Fourth Division and at the time of his permanent appointment or at any time during his temporary service he was employed in a position higher than that to which he is permanently appointed, his salary on appointment and incremental advancement shall be determined as if the whole of his continuous temporary service had been in the position to which he is appointed.

(3) The salary paid from 1st July, 1926, of any officer appointed to the permanent staff after 1st January, 1924, and prior to 1st July, 1926, shall be adjusted to a rate not less than that which would have been payable on 1st July, 1926, if the foregoing conditions had: been in operation at the time of his permanent appointment.

(4) The salary paid from the date of appointment of any officer appointed to the permanent staff after 1st July, 1926,.and prior to the date of this regulation, shall be adjusted to a rate which would have been payable upon appointment if the foregoing conditions had been in operation at the time of his permanent appointment.

(5) No increase shall be granted under this regulation which would place an officer in a more favourable position than if the whole of his service had been on the permanent staff.

 

15. Sub-regulation (2) of regulation 188 is repealed.

16. Regulation 163 is repealed and the following regulation inserted in its stead:—

Ages of candidates for Third Division.

“163. (1) The minimum age of candidates for admission to the Service in the Third Division, or for transfer from the Fourth, to the Third Division shall be as determined by the Board and notified in the Gazette, but shall not be less than fifteen years on the day of examination.

(2) Except in the case of returned soldiers, the maximum age of candidates for admission to the Service the Third Division shall be as determined by the Board and notified in the Gazette, but shall not exceed twenty-three years at last birthday on the day of examination.

(3) The minimum age for admission to the Service in the Third Division shall be as determined by the Board and notified in the Gazette, but shall not be less than sixteen years.

(4) Except in the case of returned soldiers, a successful candidate shall cease to be eligible for admission to the Service in the Third Division upon reaching the age of twenty-four years.”
