WEALTH POWERS(AlR )lA VHIATION ) [ASSENTED TO 15TH NOVEMBER, 1921.] W ACT OF 1921. HEREAS it is enacted by the constitution of the Commonwealth of Australia that the Parliament of the Commonwealth shall, subject to the constitution, have power to make laws for the peace, order, and good government of the Commonwealth with respect to matters referred to the Parliament of the Common- wealth by the Parliament or Parliaments of any State or States, but so that the la\v shall extend onlv to States by whose Parliaments the ma.tter is referred, or which afterwards adopt the law: And whereas a convention for determining by a common agreement certain uniform rules with respect to international air navigation was signed on behalf of His' Majesty in Paris on the thirtieth day of October, one thousand nine hundred and nineteen: And whereas it is expedient that provision should be made by the Parliament of the Commonwealth for the control and regulation of the navigation of aircraft and for enabling effect to be given to the said convention: And whereas at a conference of the Premiers of the States held in.,May, one thousand nine hundred and twenty, it was resolved that it is desirable that each of the Parlia- ments of the States should refer to the Parliament of the Commonwealth the matter of the control of air naviga- tion, subject to the retention by each of the States of certain rights and powers specified in the resolution: Be it therefore enacted by t.he King's Most Excellent Majesty, by and with the advice and consent of the

Legislative Council and Legislative Assembly of Queens- land in Parliament assembled, and by the authority of the same, as follows ;- . I This Act may be cited as "The Commonwealth Short title. Pou'ers (Air Navigation) Act of 1921." " 2. Subject to the limitations and reservations in this Control of Act contained, the control of air navigation is referred air. t' to the Parliament of the Commonwealth. . ~ : r: ~ ~ dl~ : Common- wealth Parliament. 3. Nothing in this Act shall empower the Parliament Saving, of the Commonwealth, or any authority constituted or to be constituted under the Commonwealth, to affect or restrict the rights and powers of the State of Queensland in regard to- (a) The acquisition or ownership by the said State of aircraft or aerodromes; or • (b) The use for the purpose of the Government of the said State of aircraft operating within the said State; or (c) Police powers; and such rights and powers shall be retained by the said State as if this Act had not been passed. 4.
