Commonwealth Education Institutions (Overseas Students) Amendment Act 1985

An Act to amend the Australian National University Act 1946 and the Canberra College of Advanced Education Act 1961 in relation to fees for overseas students

BE IT ENACTED by the Queen, and the Senate and the House of Representatives of the Commonwealth of Australia, as follows:

PART I—PRELIMINARY

Short title

1. This Act may be cited as the Commonwealth Education Institutions (Overseas Students) Amendment Act 1985.

Commencement

2. This Act shall come into operation on a day to be fixed by Proclamation.

 

PART II—AMENDMENTS OF THE AUSTRALIAN NATIONAL UNIVERSITY ACT 1946

Principal Act

3. The Australian National University Act 19461 is in this Part referred to as the Principal Act.

Statutes

4. Section 27 of the Principal Act is amended—

(a) by omitting from sub-paragraph (1) (o) (iv) “or”; and

(b) by adding at the end of paragraph (1) (o) the following word and sub-paragraph:

“or (vi) fees the imposition of which is in accordance with guidelines determined by the Minister for the purposes of paragraph (ca) of the definition of ‘fees’ in subsection 3 (1) of the States Grants (Tertiary Education Assistance) Act 1984;”.

PART III—AMENDMENTS OF THE CANBERRA COLLEGE OF ADVANCED EDUCATION ACT 1967

Principal Act

5. The Canberra College of Advanced Education Act 19672 is in this Part referred to as the Principal Act.

Fees

6. Section 25 of the Principal Act is amended—

(a) by omitting from paragraph (2) (c) “or”; and

(b) by inserting after paragraph (2) (d) the following word and paragraph:

“; or (e) fees the imposition of which is in accordance with guidelines determined by the Minister for the purposes of paragraph (ca) of the definition of ‘fees’ in sub-section 3 (1) of the States Grants (Tertiary Education Assistance) Act 1984”.
